“REGULATION ON THE COLLECTION OF FEES FOR INFORMATION SERVICES, THEIR REDUCTION AND EXEMPTION”

The regulation approved by the Government of Mongolia on February 16, 2013, in Ulaanbaatar, City Number 54.

PROVISIONS

Considering the protection of information confidentiality and the Law on the Right to Information, the following regulation is approved by the Government of Mongolia:

1. The collection, reduction, and exemption of fees for information service provision are governed by this regulation.

2. The implementation of this regulation is entrusted to the relevant authorities of the Government of Mongolia, and the Minister of Justice and Home Affairs is responsible for its enforcement.

REGULATION 54 OF 2013

REGULATIONS ON THE COLLECTION OF FEES FOR INFORMATION SERVICES, THEIR REDUCTION AND EXEMPTION

I. General Provisions

1.1. Individuals and legal entities shall adhere to this regulation regarding the collection, reduction, and exemption of fees for providing information services.

1.2. Individuals and legal entities must comply with the Law on the Right to Information and Information Security in providing information services and receiving information.

1.3. The fee specified in Article 1.1 shall not be charged in conjunction with other fees stipulated by law.

II. Payment of Service Fees

2.1. Entities specified in Article 3.1 of the Law on the Right to Information shall provide information free of charge or at a cost.

2.2. Individuals specified in Article 3.1 of the Law on the Right to Information shall pay a fee when receiving information in printed form.

2.3. The entity specified in Article 3.1 of the Law on the Right to Information shall determine the exact amount of the service fee as follows:

2.3.1. Printing information on one A-4 (single-sided) page – 50 tugriks.

2.3.2. Copying information onto one A-4 (single-sided) page – 25 tugriks.

2.4. The service fee specified in Article 2.3 may be changed depending on the company’s pricing policy. The service fee shall not exceed the cost of printing, copying, or delivering information.

2.5. Individuals specified in Article 3.1 of the Law on the Right to Information shall not be charged for the service fee specified in Articles 2.3 and 2.4 when receiving information in other forms.

2.6. The service fee specified in Article 2.3 may be paid by the relevant entity in full or in part. The service fee shall be determined by mutual agreement between the parties.

2.7. The cost of delivering information shall be added to the service fee specified in Articles 2.3 and 2.4 when delivering information directly. The price for delivering information shall be determined based on the tariffs of the Mongol Post.

III. Reduction and Exemption from Service Fees

3.1. Individuals with disabilities shall be exempt from paying the service fee specified in Articles 2.3 and 2.4.

IV. Miscellaneous

4.1. Entities shall not publish or disclose information provided by the company on their websites.

4.2. Entities specified in Article 3.1 shall comply with the conditions for providing information in electronic form specified in Article 25 of the Law on the Right to Information.

V. Responsibility

5.1. Those who violate this regulation shall be held accountable under Article 25 of the Law on the Right to Information.
